Our goal is to treat every client as we would want to be treated, and every matter as if it was our own.

Our real estate services include the following:

  • Residential and Commercial Real Estate Closings
  • Refinance, Second Mortgage, or Equity Line Closings
  • Contract Preparation and Review
  • Title Insurance

Residential and Commercial Real Estate Closings

As an attorney and member of the Attorney Title Fund Services, Inc (The Fund), we will help facilitate a diligent search of the title history and previous title policy. We’ll also investigate municipal liens, permitting issues, code violations, and review a survey (if applicable) to uncover liens, encumbrances, encroachments, easements, or other potential title issues. We also gather all necessary documents and thoroughly explain all calculations that are part of your real estate closing and transaction. We want to do all we can to make your real estate transaction as smooth and easy as possible. Also, unlike closings at most title agencies, you will have the piece of mind knowing that there will be a licensed Florida attorney involved at every step.

Refinance, Second Mortgage and Equity Line Closings

Our office has the experience necessary to oversee all aspects of these junior lien transactions. From helping you gather the necessary documentation, verifying and explaining the terms of the loan, and handling the closing, we can help make this transaction as easy and stress-free as possible.

Contract Preparation and Review

Utilizing a wealth of experience in real estate transactions, we can help prepare or review any real estate contract to ensure that the potential issues are anticipated and addressed in advance.

Title Insurance

Florida title insurance is a form of insurance which can protect the lender and the owner against a loss resulting from defects in, or undisclosed liens upon, title to real estate. Lenders typically require a mortgagee title insurance policy, and buying an owner’s policy is almost always a wise decision. As members of a comprehensive title services and title insurance organizationthe Attorney’s Title Fund Services, Inc. (The Fund)we provide thorough attention to detail and outstanding personal service. Unlike most regular insurance, that insures against future events, title insurance insures against unknown issues that might have occured in the past and that have not resulted in your having “clean” or “marketable” title. And unlike regular insurance, where there ongoing premium payments, title insurance is paid at closing with one-time flat fee.

Real Estate Closings: Securing Your Investment with Expert Legal Protection

A real estate transaction, whether buying, selling, or refinancing, represents one of the most significant financial endeavors in most people’s lives. It’s a complex process involving many legal documents, critical deadlines, and substantial financial commitments. Without experienced legal guidance, navigating these intricacies can be daunting and expose you to unnecessary risks.

At the Law Offices of Evan M. Rosen, P.A., we provide comprehensive real estate closing services, ensuring that your interests are fully protected from contract to keys. Our dedicated team of real estate attorneys and staff meticulously handle every detail, providing the peace of mind that your transaction is handled correctly, legally, and efficiently.

Why Choose a Law Firm for Your Real Estate Closing?

While title companies play an essential role in facilitating closings, a law firm offers a crucial layer of legal protection and advocacy that a non-attorney title agent cannot.

  • Your Advocate: A title company typically acts as a neutral third party. As your attorney, we often represent our client’s interests—offering legal advice, negotiating on their behalf, and safeguarding them against potential pitfalls.
  • Risk Mitigation: We conduct thorough due diligence, identifying and resolving complex issues such as title defects, hidden liens, boundary disputes, or contract ambiguities before they become costly problems at or after closing.
  • Problem Solving: Unexpected issues can arise. Our legal expertise allows us to quickly draft specialized documents, modify agreements, or litigate minor disputes, ensuring your closing stays on track. Title companies generally cannot do this.
  • Comprehensive Counsel: From reviewing the initial contract to explaining every closing document, we can provide legal advice every step of the way, ensuring you understand exactly what you’re signing.
  • Beyond Paperwork: We don’t just process forms; we provide legal interpretations, clarify obligations, and protect your rights in what is often your largest financial transaction.

Our Comprehensive Real Estate Closing Services

We represent various parties in real estate transactions, providing tailored services to meet your specific needs:

For Buyers:

  • Title and Lien Searches and Examination: Meticulous investigation of the property’s title and municipal lien history to uncover any outstanding balances, code or permitting issues, easements, and/or encumbrances.
  • Title Insurance: Issuing comprehensive title insurance policies to protect your investment from title defects.
  • Loan Document Review: Explaining complex mortgage documents and ensuring they align with your understanding.
  • Due Diligence Guidance: Advising on property inspections, appraisals, and other critical investigations.
  • Closing Representation: Attending the closing to ensure all documents are accurate, funds are properly disbursed, and your interests are fully protected.
